Agreement

These Terms and Conditions, along with our Privacy Policy, govern the use of services provided by Deep Sensations Freediving ("Deep Sensations", "we", "our" or "us") accessible through the website located at deepsensationsfreediving.com ("Site").
By accessing, browsing, or using the Site, you acknowledge and agree to abide by these Terms and Conditions and our Privacy Policy (together, the "Agreement"). If you do not consent to these terms, you must refrain from accessing or using the Site and our services.
Upon purchasing any service from us, you are engaging in our "Service" and are bound by the Agreement, including any additional terms, conditions, and policies referenced herein or made available through hyperlinks. This Agreement applies to all participants, including but not limited to users, customers, vendors, and contributors of content.

2. Interpretation

In this Agreement, unless the context otherwise requires:

“Agreement” means these Terms and Conditions, together with our Privacy Policy and any additional terms, conditions, or policies referenced herein or made available through hyperlinks.
“Booking” means any confirmed reservation made by a participant for a Course, Training session, Retreat, Expedition, or any other Service provided by Deep Sensations Freediving.
“Course” means any freediving, breathwork, or related training program offered by Deep Sensations Freediving.
“Participant”, “you”, or “your” refers to any person accessing the Site or engaging in our Services.
“Deposit” means a non-refundable amount required to secure a Booking.
“Force Majeure” refers to any event or circumstance beyond the reasonable control of Deep Sensations Freediving, including but not limited to natural disasters, extreme weather, government restrictions, war, pandemics, or industrial actions.
“Retreat” includes any multi-day trip, expedition, or experience operated or facilitated by Deep Sensations Freediving.
“Service(s)” means any product, course, training session, retreat, tour, workshop, or other offering provided by Deep Sensations Freediving, whether paid or complimentary.
“Site” refers to the Deep Sensations Freediving website located at www.deepsensationsfreediving.com.
“Training” refers to structured in-water practice sessions, including Line/Depth Training and Pool Training.
“We”, “us”, “our”, or “Deep Sensations Freediving” refers to Deep Sensations Freediving, its instructors, staff, contractors, and authorised representatives.

3. Site Use

By accessing or using the Site, you warrant that your activities comply with applicable laws and regulations. Any suspected fraudulent, abusive, or unlawful activity will be reported to relevant authorities.
Links to third-party websites provided on the Site are for convenience only. Deep Sensations Freediving does not endorse or guarantee any third-party content or services and assumes no liability for their use.
You agree to use the Site solely for its intended purpose and refrain from any activity that disrupts its functionality or security. Unless expressly permitted, you must not copy, distribute, or modify any content on the Site.
You are responsible for safeguarding your devices from viruses or other malicious software when accessing the Site.

4. General Services Conditions

Deep Sensations Freediving reserves the right to refuse services to any individual at its discretion.
Age Requirement: All participants must be at least 18 years of age to book our product. Minors under the age of 18 require written and signed permission from a parent or legal guardian to participate.
Deep Sensations Freediving may alter its offerings or services due to unforeseen circumstances. In such cases, affected individuals will be notified promptly.
Deposit amount must be paid at the time of booking to secure your spot.
The full amount of the trip must be paid at least 12 weeks prior to the trip commencement date.

5. Deep Sensations Freediving Services Order Process

Orders placed through the Site are subject to availability and acceptance by Deep Sensations Freediving. An Order is confirmed upon receipt of payment and confirmation from Deep Sensations Freediving.
We reserve the right to decline sales at our discretion.

6. General Booking Requirements

To book any Service, participants must provide: (i) Medical History form; (ii) Waiver form; (iii) Compliance with government health regulations.
Failure to provide required information may result in booking cancellation without refund.

7. Booking Policy – Courses

Course bookings are confirmed upon: (i) Placement of an Order; (ii) Full payment; (iii) Receipt of payment by Deep Sensations Freediving.

7.1 Overview
At Deep Sensations Freediving, our goal is to ensure every student has the opportunity to complete their certification stress-free.

If you do not meet all course requirements within your initial two-day course for non-medical reasons, you will receive complimentary training for up to 12 months to help you complete your certification.

To be eligible, you must have attended both full days of the course in their entirety. Students who leave early or fail to participate in all required sessions will not qualify for complimentary training.

7.2 Training Availability

Due to our strict 4:1 instructor-to-student ratio, spaces on each buoy during line-training sessions are limited.
Complimentary training is subject to availability and will only be offered when spare spaces become available. Deep Sensations Freediving will generally contact eligible students by email during the week of the session.
Spaces are allocated on a first come, first served basis and cannot be guaranteed.
Students wishing to secure a specific or preferred training date may book in advance at the standard line-training session rate.
If you accept a complimentary training session and fail to attend, or cancel within 72 hours of the scheduled session, your remaining 12-month complimentary training entitlement will be forfeited.
Any request to reschedule a confirmed complimentary training session will be subject to our standard training terms and conditions.

7.3 Gear Hire
Complimentary training does not include equipment hire.
Gear can be rented for $40 per day if required.

7.4 Terms and Conditions

The Stress-Free Certification Policy applies only to courses booked on or after 5 October 2024.
Claims must be made within 12 months of your original course date.
Once you have met all course requirements and have been signed off by an instructor, complimentary training will end.
If an instructor suspects that medical reasons (e.g., chronic sinus inflammation or eustachian tube dysfunction) are preventing you from completing your course, you will be asked to seek medical advice.
If a medical condition is confirmed as the limiting factor, you will not be eligible for the Certification Guarantee.

If an instructor suspects that medical reasons (e.g., dysfunctional eustachian tubes, chronic sinus inflammation) may be preventing you from meeting requirements, you must seek medical advice.

If a medical issue is confirmed, you will not be eligible for the the Complimentary Training.

8. Booking Policy – Training

"Training" refers to Line/Depth Training and Pool Training.
Training bookings are confirmed upon: (i) Placement of an Order; (ii) Full payment; (iii) Receipt of payment by Deep Sensations Freediving.

9. Booking Policy – Retreats

Booking a Retreat requires: (i) Payment of a non-refundable deposit or greater amount; (ii) Receipt of the deposit or greater amount by Deep Sensations Freediving.
For bookings made less than six weeks in advance, full payment is required to confirm.
Participants must obtain comprehensive travel insurance, including coverage for medical expenses and trip cancellation.

10. Student Cancellation – Courses

10.1 Non-refundable bookings
All course bookings are non-refundable once confirmed. Refunds are not provided for change of mind or personal reasons, regardless of notice period.

10.2 Rescheduling (non-medical)

One reschedule only, requested 21 or more days before the course start, subject to a $150 rescheduling fee and availability.

Reschedule requests within 21 days of the course start are not permitted and will be treated as a no-show.

Any additional change after the one permitted reschedule is not allowed. Deep Sensations Freediving may cancel your space with no refund or credit.

10.3 Medical exception (transfer only, fee waived)

If you are medically unfit to participate, provide a valid medical certificate within 7 days of notifying us.
With a valid certificate, we will offer a one-time transfer to a future course date within 12 months, and the $150 rescheduling fee is waived. No refunds are issued.

This medical transfer may be approved at any time, including within 21 days of the start date.

You may be required to obtain medical clearance before continuing training.

No refunds are available under this clause.

10.4 No-shows and missed activities
Failure to attend any session (pool, theory, or ocean), late arrival, or early departure is treated as a no-show. No refunds or credits are provided for missed activities.

10.5 Non-refundable components

Third-party e-learning fees, including access to online course materials, are non-refundable once access has been issued.
Where a refund is otherwise approved under these Terms and Conditions, a $100 deduction will apply to cover e-learning and administrative costs if online materials have already been issued.
Approved course transfers do not include the re-issuance of e-learning materials. Any additional or replacement access required may incur a further fee.

11. Student Cancellation – Line Training, Pool Training and Depth Coaching

11.1 Non-refundable bookings
All Training bookings are non-refundable once confirmed. Refunds are not provided for change of mind or personal reasons, regardless of notice period.

11.2 Cancellations at any time
Cancellations at any time, including 14 days or more before the scheduled Training, are not eligible for a refund.

11.3 No-shows and missed activities
Failure to attend, late arrival, or early departure is treated as a no-show. No refunds or credits will be issued for missed activities.

11.4 Medical exception (transfer only)
If you are medically unfit to participate, provide a valid medical certificate within 48 hours of notifying us. At our discretion, we may offer a one-time transfer to a future Training date within 6 months. No refunds will be issued.

11.5 Student Cancellation – Line Training

Cancellation 14 days or more before Training: 100% refund.
Cancellation less than 14 days before Training: No refund.
Exceptions may not be made, and no credit will be offered for missed activities.

12. Student Cancellation and Transfers – Retreats, Trips, Social Weekends and Expeditions

Our retreats require significant advance planning and financial commitments, including accommodation, vessels, flights, operators, permits and other third-party services. For this reason, the following cancellation terms apply to all retreat bookings.

12.1 Deposits
All retreat deposits are non-refundable.

12.2 Cancellations

Cancellations More Than 6 Months Before the Retreat Start

If you cancel more than six months before the retreat start date, you may be eligible for a refund of payments made, less the non-refundable deposit and a 5% cancellation administration fee calculated on payments made excluding the deposit.
The deposit and administration fee are intended to cover reasonable booking administration, processing costs and losses associated with cancellations. Any deductions will be limited to amounts permitted under Australian Consumer Law.

Cancellations between 3 and 6 months before the retreat start date

You are eligible for a 50% refund of payments made, less the non-refundable deposit.

Cancellations less than 3 months before the retreat start date

Payments are non-refundable.

12.3 Transfers

Bookings are made for specific retreat dates and cannot automatically be transferred to another retreat or departure.
Where requested, Deep Sensations Freediving may, at its discretion, allow a booking to be transferred to another available retreat, or individual.
Transfer fees may apply to cover reasonable administrative costs and any costs associated with changing or replacing bookings already made on your behalf, including accommodation, flights, vessels, operators or other third-party services.
Any difference in price between the original retreat and the new retreat will also be payable.
Transfers are subject to availability and are not guaranteed.

12.4 Medical or Personal Circumstances

The same cancellation and transfer conditions apply where you are unable to attend due to illness, injury, medical circumstances or other personal circumstances.
For this reason, we strongly recommend comprehensive travel insurance from the time you make your booking, including appropriate cancellation cover.
If you are unable to attend, we are happy to assist with reasonable documentation required by your travel insurer, including confirmation of your booking, amounts paid, cancellation or non-attendance, and our applicable refund policy.
Approval of any insurance claim is entirely at the discretion of your insurer.

12.5 Missed Activities or Late Arrival

No refund, credit or rescheduling will be provided for activities, sessions, accommodation, transfers or experiences missed due to late arrival, early departure, illness, personal circumstances or a decision not to participate once the retreat has commenced.

12.6 Third-Party & Non-Recoverable Costs

Where Deep Sensations Freediving has already incurred non-refundable or non-recoverable costs specifically associated with your booking, these costs may be deducted from any refund or transfer amount where permitted by law.
Where reasonably possible, we will attempt to minimise losses associated with a cancellation.

12.7 Australian Consumer Law

Nothing in this policy is intended to exclude, restrict or modify any rights or remedies available to you under the Australian Consumer Law that cannot legally be excluded.

13. Deep Sensations Freediving Cancellation Policy

Deep Sensations Freediving may occasionally need to cancel, postpone, reschedule, modify or partially cancel a service due to circumstances including adverse weather or ocean conditions, safety concerns, staff illness or injury, vessel or equipment issues, operator availability, or minimum participant numbers not being met.

Where reasonably possible, Deep Sensations Freediving will first seek to provide the affected service on an alternative date, through a replacement activity, or through another reasonable arrangement.

Where an entire course, tour, retreat or expedition is cancelled or postponed for reasons outside the reasonable control of Deep Sensations Freediving, participants may be transferred to an alternative date within 12 months of the original booking, subject to availability and any rights that apply under Australian Consumer Law.

Deep Sensations Freediving will make reasonable efforts to provide suitable alternative dates; however, specific dates cannot be guaranteed.

Partial Cancellations

Where only part of a course, tour, retreat or expedition is cancelled, the remainder of the booking will continue wherever reasonably possible.

If a specific separately identifiable component of the booking is cancelled and cannot reasonably be rescheduled or replaced with an equivalent activity, participants will receive a refund equivalent to the value allocated to that cancelled component.

For example, if one scheduled boat day forming part of a multi-day Byron Bay trip is cancelled and cannot be rescheduled or replaced, participants will be refunded the amount attributable to the boat component of that day.

A partial cancellation does not automatically entitle a participant to cancel or receive a refund for unaffected portions of the trip.

Where a cancelled activity is reasonably replaced with an activity or service of comparable nature and value, no additional refund will ordinarily apply, subject always to Australian Consumer Law.

Where a cancellation or service failure occurs due to circumstances within Deep Sensations Freediving’s reasonable control and applicable consumer law entitles the participant to a remedy, Deep Sensations Freediving will provide the remedy required by law, which may include:

a refund for the affected or unused portion of the service;
an alternative service or replacement activity; or
transfer to an alternative date.

Deep Sensations Freediving is not responsible for indirect or consequential costs arising from a cancellation, postponement, rescheduling or itinerary change, including accommodation, airfares, transport or other associated travel expenses, except where liability cannot lawfully be excluded under Australian Consumer Law.

13.1 Force Majeure

Force majeure events are events beyond the reasonable control of Deep Sensations Freediving and may include, without limitation: adverse weather or ocean conditions, natural disasters, fire, flood, acts of God, war, armed conflict, civil unrest, terrorism, riots, epidemics, pandemics, strikes, industrial disputes, government directions or restrictions, travel bans, border closures, airspace closures, port closures, route closures, fuel shortages, transport disruptions, supply chain failures, and vessel, airline, accommodation, operator or other third-party service failures that make a trip unsafe, impracticable or impossible to operate as planned.

Where a trip is cancelled, delayed, curtailed, rescheduled or materially changed due to a force majeure event, Deep Sensations Freediving may provide a reschedule, credit, substitute itinerary, alternative activity or other reasonable arrangement, having regard to the nature of the disruption, non-recoverable costs already incurred and any rights available under Australian Consumer Law.

Where only one component of the trip is affected, the remainder of the trip will continue wherever reasonably practicable.

If the affected component cannot reasonably be rescheduled or replaced and Deep Sensations Freediving receives or retains the value attributable to that component, a refund or adjustment may be provided for that component, subject to non-recoverable third-party costs and applicable consumer law.

Deep Sensations Freediving will not be liable for losses, delays or additional expenses arising directly from a force majeure event except to the extent that liability cannot lawfully be excluded.

If DFAT/Smartraveller issues a Level 3: Reconsider your need to travel or Level 4: Do not travel advisory for the destination or relevant region, Deep Sensations Freediving may cancel, postpone, reschedule or materially alter the trip.

Any refund, partial refund, credit, reschedule or alternative arrangement will be assessed having regard to unrecoverable third-party costs, the services already supplied and any rights applying under Australian Consumer Law.

13.2 Minimum Participant Requirements

Some courses, training sessions, tours, retreats and expeditions require a minimum number of participants to proceed.

Courses and Training Sessions

If minimum participant numbers are not met at least 48 hours prior to the scheduled start date, Deep Sensations Freediving reserves the right to cancel or postpone the course.

Participants will ordinarily be transferred to an alternative course date within 12 months of the original booking, subject to availability and Australian Consumer Law.

Tours, Retreats, Social Weekends and Expeditions

If minimum participant numbers are not met at least 6 weeks prior to the scheduled start date, Deep Sensations Freediving reserves the right to cancel or postpone the trip.

Participants will ordinarily be transferred to an alternative departure within 12 months of the original booking, subject to availability and Australian Consumer Law.

In all cases, Deep Sensations Freediving will make reasonable efforts to provide suitable alternative dates.

Any refund, credit or other remedy will be determined in accordance with these Terms and Conditions and any rights that apply under Australian Consumer Law.

13.3 Safety-Related Cancellations - Courses and Training

If a course, training session, dive, tour or activity is cancelled, shortened or postponed due to safety concerns, including adverse weather or changing ocean conditions, no refund will ordinarily be issued.
Participants will instead be offered a complimentary transfer to complete any outstanding components on an alternative date, subject to availability.
If a separately identifiable paid component is cancelled and cannot be rescheduled or replaced, any refund will be limited to the value of that affected component.
Nothing in this section limits any rights under Australian Consumer Law.

14. Spearfishing Courses

Spearfishing is an inherently hazardous ocean activity and is subject to specific fishing laws, marine park restrictions and environmental conditions. By participating in a Deep Sensations Freediving spearfishing course, participants acknowledge and accept the inherent risks associated with freediving, spearfishing and the marine environment.

14.1 Licences, Fishing Rules & Catch Responsibility

Participants are responsible for ensuring they comply with all applicable NSW fishing laws and regulations.

Participants must:

- hold a valid NSW Recreational Fishing Fee receipt unless legally exempt;
- familiarise themselves with current fishing regulations before participating;
- comply with all applicable size, bag and possession limits;
- comply with marine park zoning, sanctuary zones, aquatic reserves, fishing closures and other location-specific restrictions;
- ensure any species taken is legal to target, take and possess; and
- correctly identify, measure and manage their own catch.

NSW fishing rules, including bag and size limits, apply to spearfishing, and some marine parks, aquatic reserves and other areas have additional restrictions or prohibit spearfishing entirely.

Deep Sensations Freediving may provide general education regarding species identification, fishing regulations and responsible spearfishing practices; however, the decision to shoot, take, retain or release a fish or other marine species remains the participant’s responsibility.

Participants are responsible for confirming that their catch is legal before taking it. Deep Sensations Freediving accepts no responsibility for fines, penalties, confiscation of equipment or catch, or other consequences arising from a participant’s failure to comply with applicable fishing laws or regulations.

14.2 Safety & Inherent Risks

Participants acknowledge that spearfishing involves inherent risks, including but not limited to:

- shallow-water blackout, loss of motor control and other freediving-related risks;
- adverse weather, swell, waves, currents and changing ocean conditions;
- rocks, reefs, vessels and submerged hazards;
- marine animals and potentially dangerous marine life;
- spearguns, polespears, knives and other fishing equipment;
- entanglement in fishing lines, floats, ropes or marine debris; and
- injury arising from the actions of other participants or water users.

Participants must follow all safety instructions provided by Deep Sensations Freediving staff and must not operate a speargun or other equipment in a manner considered unsafe.

Deep Sensations Freediving reserves the right to prevent or remove a participant from an activity where their behaviour, equipment, ability, health, fitness, competence or compliance with instructions presents an unacceptable safety risk.

14.3 Ocean Conditions & Course Rescheduling

Spearfishing courses are highly dependent on suitable ocean conditions.

For the safety of participants and to provide an appropriate course experience, Deep Sensations Freediving may cancel, postpone, relocate or reschedule a course due to unsuitable conditions, including but not limited to:

- swell or surf conditions;
- strong winds or currents;
- poor visibility;
- significant rainfall, flooding or water-quality concerns;
- dangerous marine conditions;
- weather warnings or forecasts; or
- any other condition considered unsuitable for safe or effective spearfishing training.

These decisions may be made before the course or on the day and are at the discretion of Deep Sensations Freediving based on the available conditions and forecasts.

Where a course is postponed or cancelled due to unsuitable ocean or safety conditions, participants will be offered a complimentary transfer to an alternative available course date.

Refunds will not ordinarily be provided where a reasonable alternative date is offered, subject to any rights that cannot be excluded under Australian Consumer Law.

Deep Sensations Freediving is not responsible for associated travel, accommodation or other costs incurred as a result of weather-related cancellations, postponements, relocations or rescheduling, except where liability cannot lawfully be excluded.

14.4 Participant Responsibility

Participants remain responsible for assessing their own ability, comfort and suitability to participate.

Participation in a Deep Sensations Freediving course does not guarantee that a participant will successfully catch fish, encounter particular species, or experience specific ocean or visibility conditions.

All fishing and hunting decisions ultimately remain the responsibility of the individual participant.

Nothing in this section excludes or limits any rights, guarantees or liabilities that cannot lawfully be excluded under Australian Consumer Law.

15. Credits and deposits

Credits issued for cancellations or changes to reservations are not transferrable to other parties.
Additionally, deposits made to secure a spot on a retreat cannot be transferred to another retreat.

16. Pricing

All prices on the Site are in Australian Dollars and include GST unless otherwise stated.
Prices are subject to change without notice. Once an Order is confirmed, subsequent price changes will not affect the Order.

17. Promotions and Gift Vouchers

Gift vouchers are valid for 12 months from the date of purchase.
Package offers must be booked within 12 months of purchase.
Coupon codes may only be used once per customer, unless specified otherwise.
Promotional discount codes are subject to terms notified at the time of the offer.
Coupon or promotional codes cannot be applied to any product or service where the discount value exceeds 50% of the total purchase price, unless explicitly stated otherwise in the promotion.

18. Payment

Payment for Orders can be made through methods specified on the Site. Credit card payments may incur a surcharge.
We reserve the right to investigate and verify electronic transactions. Orders may be rescinded if additional information is not provided.
Payment processing is handled by Stripe, subject to the Stripe Services Agreement.

19. Liability

Deep Sensations Freediving excludes all conditions, guarantees, and warranties to the maximum extent permitted by law.

We are not liable for any personal injury, death, or direct, indirect, or consequential loss arising from the use of our services, including participation in retreats, tours, or training sessions.

Our maximum aggregate liability is AUD $20,000,000.00.

We reserve the right to correct any errors or omissions in the information provided.

20. Third-Party Services

We collaborate with carefully selected third-party providers who align with our safety and quality standards. These providers operate under their own terms and conditions and are subject to the laws of their respective jurisdictions.

Deep Sensations Freediving does not control how third-party providers conduct their services and, therefore, is not liable for any:

Personal injury, death, or property damage
Loss, accident, delay, or inconvenience
Modifications, cancellations, or service disruptions

By engaging with third-party providers, you acknowledge that any liability for issues arising from their services rests with the provider.

We strongly recommend securing comprehensive travel insurance to cover medical expenses, cancellations, theft, and other unforeseen circumstances.

21. Authority of the Tour Manager or Freediving Instructor

Your safety and well-being are our top priorities. Deep Sensations Freediving retains full discretion in all decisions that may impact your safety or continued participation in any activity, tour, or retreat.

If you fail to follow instructions, engage in disruptive or abusive behavior, or compromise the well-being of the group, we reserve the right to remove you from the tour immediately. In such cases:

No refunds or reimbursements will be provided.
We are not responsible for any compensation, costs, or losses resulting from your removal.

Your cooperation and respect ensure a safe and enjoyable experience for everyone.

22. Travel Insurance Requirement

For all retreats and experiences, Deep Sensations Freediving is not liable for any:

Lost or stolen belongings
Damaged equipment
Additional costs due to delays or schedule changes

Comprehensive travel insurance is mandatory for all international and domestic retreats and tours. Your policy must cover:

Medical expenses
Trip cancellations
Injuries
Theft and loss

This ensures you are fully protected throughout your experience.

23. Passports, Visas & Health Requirements

To confirm your booking, you must provide a clear scanned copy of the photo page of your passport when submitting your booking request or paying the deposit.

It is your responsibility to ensure your passport is valid for international travel. Your passport must have at least six months of validity beyond your scheduled return date.

You are solely responsible for obtaining any required visas for entry into your destination country. Failure to secure the correct visa does not qualify you for a refund.

We strongly recommend that you stay informed about local travel advisories, health precautions, and security updates by visiting Smartraveller and subscribing to relevant alerts.

24. Marine Interactions & Ethical Conduct

At Deep Sensations Freediving, we are committed to responsible and ethical marine interactions. All participants must adhere to international and local marine conservation laws and environmental protection guidelines. Our operators uphold the highest standards of eco-friendly practices, and we expect all participants to do the same.

24.1. Code of Conduct for Marine Encounters

When engaging with marine life, you must follow these guidelines:

No touching, chasing, or harassing marine animals. Observe respectfully from a safe distance.
Do not interfere with natural behaviors, feeding, or movement patterns.
Avoid contact with coral reefs, seagrass beds, or sensitive habitats. Be mindful of your buoyancy and movements.
Do not feed wildlife—human interaction can disrupt natural diets and behaviors.
Follow all instructions from your guides and instructors regarding safe and ethical marine encounters.

24.2. Regulatory Compliance

All participants must comply with:

Australian and international marine protection laws
Local regulations governing marine sanctuaries and protected areas
Best practices set by our freediving school and partnered operators

Any violation of these guidelines may result in removal from activities without a refund. We are dedicated to preserving the ocean for future generations and expect all participants to share this responsibility.

25. User Comments, Feedback, and Photos

Photos and videos may be taken during our Services for marketing purposes unless participants opt out.
Photos captured during our Services can be used for social media and personal use, provided credit is given to @deepsensationsfreediving and the underwater photographer responsible. These photos must not be used for commercial, marketing, or other unauthorised purposes.
Comments or submissions may be used by us without restriction.
We may monitor, edit, or remove content deemed unlawful or inappropriate.
Participants must not submit material that violates third-party rights or contains malicious content.

26. Intellectual Property

We retain ownership of all Intellectual Property Rights in the Site and Material.

27. Linking to the Site

Participants must not establish links suggesting association with us.
Links must not originate from websites not owned by participants.
Framing the Site or deep linking requires our permission.

28. Indemnity

Participants agree to indemnify us and hold us harmless from any claims arising from their use of the Site or Services.

29. Privacy

We are committed to protecting participant privacy. Refer to our Privacy Policy for details.

30. General

We may amend this Agreement without notice.
We provide information on the Site to the best of our ability but do not guarantee accuracy.
Void or unenforceable provisions may be severed without affecting other provisions.
Failure to exercise a right does not waive it.
This Agreement is governed by the laws of New South Wales, Australia, and parties submit to the jurisdiction of its courts.
By accessing or using our Services, you agree to abide by this Agreement and any updates or amendments. If you do not agree with any part of this Agreement, you must refrain from using our Services.
Deposit amount must be paid at the time of booking to secure your spot.
The full amount of the trip must be paid at least 10 weeks prior to the trip commencement date.
Deep Sensations Freediving reserves the right to cancel or postpone a trip at any time, including if minimum required numbers have not been met, weather conditions are not suitable, or if Deep Sensations Freediving deems conditions are not safe to proceed for any reason.
If a trip has been postponed, Deep Sensations Freediving is not required to refund participants and will provide alternative dates for attendance. If the alternative dates are cancelled or postponed by Deep Sensations Freediving for any reason, participants will again be provided with alternative dates. The trip must be completed within 1 year of the original trip date.
Once booked on to a trip, participants must comply with payment plans within information packs and digital flyers. 2nd and 3rd payments are nonrefundable.
It is the responsibility of participants to get to the location of the trip/retreat/camp. Deep Sensations Freediving will not pay for flights or taxis.
We highly recommend participants purchase travel insurance at the time of booking.
If a vendor raises their prices while participants are booked on to a trip, Deep Sensations Freediving reserves the right to adjust prices to match the vendor.
Deep Sensations Freediving has the right to make any changes to trips, retreats, or camps including locations, accommodation, special guests, group sizes, and price.

21. Compliance

These Terms and Conditions were written in accordance with the ACCC guidelines and industry standards.
